OVERVIEW

Welcome to Casket Gallery (“Casket Gallery,” “we,” “us,” or “our”). Casket Gallery operates www.casketgallery.com (the “Site”) and provides access to funeral merchandise, including caskets, urns, and headstones, through an online shopping platform (collectively, the “Services”).

Casket Gallery sells funeral merchandise independently of funeral services. Customers are not required to purchase funeral services, embalming, or any other goods or services in order to purchase merchandise from us.

By accessing or using the Services, you agree to these Terms of Service (“Terms”) and our Privacy Policy [LINK]. If you do not agree, you may not use the Services.

IMPORTANT FTC FUNERAL RULE DISCLOSURE

Under the Federal Trade Commission (FTC) Funeral Rule, consumers have the right to:

  • Purchase caskets, urns, and other funeral merchandise from any provider of their choice
  • Use funeral merchandise purchased from third parties without penalty or additional fees
  • Decline any goods or services they do not want

Casket Gallery is not affiliated with any funeral home or cemetery, unless expressly stated. Funeral homes and cemeteries are required by federal law to accept funeral merchandise purchased from third-party sellers, including Casket Gallery.

SECTION 1 – ACCESS AND ACCOUNT

You must be at least the age of majority in your state or province to use the Services.

You agree to provide accurate, current, and complete information when placing an order and to keep your information updated.

You are responsible for safeguarding your account credentials and for all activity under your account.

SECTION 2 – OUR PRODUCTS

Casket Gallery offers caskets, urns, and headstones for individual purchase.

  • Our products are sold à la carte
  • No funeral services are included or required
  • No additional products or services are required as a condition of purchase

Product images and descriptions are provided for reference only. Variations may occur due to materials, finishes, craftsmanship, and display settings.

We reserve the right to change product offerings, specifications, or pricing at any time without notice.

SECTION 3 – ORDERS

Placing an order constitutes an offer to purchase funeral merchandise only.

Orders are accepted once payment is received and confirmation is issued. Orders may not be canceled or modified once accepted except as permitted by our Refund Policy [LINK].

We may contact you to coordinate delivery details but will not require the purchase of additional goods or services as a condition of fulfillment.

SECTION 4 – PRICES AND BILLING

All prices are clearly disclosed prior to purchase.

  • Prices reflect merchandise only
  • Funeral services, embalming, or cemetery services are not included
  • Shipping, freight, and delivery upgrades are disclosed separately

You agree to pay the total amount displayed at checkout.

SECTION 5 – SHIPPING AND DELIVERY

We ship nationwide within the United States.

Certain products, including caskets and headstones, require freight (LTL) delivery.

Delivery terms:

  • Standard delivery includes curbside delivery
  • White glove delivery includes inside delivery and placement
  • Adult signature is required
  • Delivery times are estimates and not guaranteed

Funeral homes, cemeteries, and residences are all acceptable delivery locations.

SECTION 6 – FUNERAL HOME ACCEPTANCE

Federal law requires funeral homes to accept caskets purchased from third-party sellers.

Casket Gallery will coordinate delivery directly with the receiving location when necessary. Any refusal by a funeral home to accept delivery should be reported to us immediately so we may assist.

SECTION 7 – INSPECTION & DAMAGES

Customers should inspect merchandise at delivery.

Damage must be documented at delivery and reported immediately to preserve carrier claims.

SECTION 8 – INTELLECTUAL PROPERTY

All content on the Site is owned by or licensed to Casket Gallery and may not be used without permission.

SECTION 9 – OPTIONAL TOOLS

Third-party tools are provided “as is” and without warranties.

SECTION 10 – THIRD-PARTY LINKS

We are not responsible for third-party websites or services.

SECTION 11 – RELATIONSHIP WITH SHOPIFY

Casket Gallery uses Shopify to operate the Site. All purchases are made directly with Casket Gallery. Shopify bears no responsibility for products, deliveries, or disputes.

SECTION 12 – PRIVACY POLICY

Your use of the Services is subject to our Privacy Policy [LINK] and Shopify’s Privacy Policy.

SECTION 13 – FEEDBACK

Feedback may be used by Casket Gallery without restriction.

SECTION 14 – ERRORS & OMISSIONS

We reserve the right to correct errors or cancel orders if information is inaccurate.

SECTION 15 – PROHIBITED USES

You may not misuse the Services or violate applicable laws.

SECTION 16 – TERMINATION

We may terminate access at any time. Obligations incurred prior to termination survive.

SECTION 17 – DISCLAIMER OF WARRANTIES

ALL PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Casket Gallery shall not be liable for indirect, incidental, or consequential damages.

SECTION 19 – INDEMNIFICATION

You agree to indemnify Casket Gallery and Shopify against claims arising from misuse of the Services.

SECTION 20 – SEVERABILITY

If any provision is unenforceable, the remaining provisions remain in effect.

SECTION 21 – GOVERNING LAW

These Terms are governed by the laws of the state where Casket Gallery is headquartered.

SECTION 22 – CHANGES TO TERMS

We may update these Terms at any time by posting revisions to the Site.
